TERMS AND CONDITIONS

1. Introduction

Welcome to Cecropia Travel. By booking any travel package or activity with us, you agree to abide by the following terms and conditions. Please read them carefully.
2. Acceptance of Terms
By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions, including any additional guidelines or future modifications.
3. Booking and Payment
  • Booking: All bookings must be made through our website or authorised agents.
  • Payment: A non-refundable deposit of 15% total trip price is required at the time of booking. Full payment must be made no more than 91 days before the departure date. Failure to do so may result in a loss of deposit and/or a booking. 
4. Cancellation and Refund Policy
  • Cancellation by Client: If you need to cancel your booking, please notify us in writing at [email protected]. 
  • In calculating cancellation fees, we have taken account the costs incurred by us in organising, planning and booking your holiday, as well as any income we may have received generated from your booking to offset our loss.

The cancellation fee is calculated as follows:

  • Cancellation by Company: We reserve the right to cancel any trip due to safety concerns, or other unforeseen circumstances. In such cases, we will reach out with alternative options. This could be in the form of a rescheduled trip or full refund. 
  • Alterations or cancellations by you during or after travel: If you wish to make any changes to your booking whilst you are travelling, or should you have any complaints, please do inform us immediately at [email protected]. Whilst we will do our utmost to honour your requests, this may not always be possible. If you do not reach out to us during your trip and wait until after you have returned to make any request for a refund, this unfortunately cannot be accepted. 
5. Assumption of Risk
  • Wild Animals and Dangerous Plants: Our trips may involve encounters with wild animals and exposure to dangerous plants. While we take safety precautions, these elements are inherently unpredictable and can pose risks.
  • High-Adrenaline Activities: Activities such as white water rafting, hiking, and other adventure sports carry inherent risks. Participants must be aware of these risks and accept responsibility for their participation.
6. Health and Fitness Requirements
  • Medical Conditions: Prior to booking with us, you must disclose any pre-existing medical conditions, mobility and disability requirements that may affect your ability to participate in our activities. Failure to disclose such information may result in cancellation without refund.
  • Fitness Level: Participants should be in good physical condition and capable of undertaking the activities involved. We reserve the right to refuse participation to anyone deemed unfit.  Due to the nature of some of our activities, and the topography of our destinations, it may not always be possible for us to facilitate those with reduced mobility. However, we will be more than happy to discuss other options of creating a tailor-made itinerary for you that takes into consideration your level of mobility. Full details must be confirmed in writing at the time of booking and whenever any change in the condition or disability occurs.
  • Special dietary requirements and allergies: Special dietary requirement should be noted on the booking form. Allergy requirements should also be brought to the attention of your driver once you have landed - with your consent, we will brief our driver with any dietary requirements you may have to ensure they are aware, but it is recommended you should also make them aware.
7. Insurance
It is mandatory for all participants to have travel insurance that covers adventure activities, medical expenses, and emergency evacuation. Proof of insurance must be provided prior to departure. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects.
8. Liability Waiver
By participating in our trips, you agree to release Cecropia Travel, its employees, and agents from any liability for personal injury, death, property damage, or any other loss incurred during the trip, except where caused by gross negligence.
9. Code of Conduct
  • Respect for Wildlife and Environment: Participants must follow all guidelines regarding interaction with wildlife and preservation of the natural environment.
  • Behaviour: Disruptive or unsafe behaviour will not be tolerated. We reserve the right to remove any participant from the trip without refund for misconduct.
10. Complaints and Dispute Resolution
  • Complaints: Any complaints should be reported to the trip leader as soon as possible. We will address complaints promptly and fairly.
  • Dispute Resolution: Should you have any complaints about any aspect of your holiday arrangements, you must inform our local representative immediately. 
    Problems can most easily be dealt with on the spot. Please note, if you do not report a problem or complaint straight away which, if it had been reported at the time it occurred, could have been quickly resolved, we cannot accept any liability in respect of that problem or complaint. It is sensible to expect a client travelling in the developing world to be reasonably resourceful if things go wrong. If you experience any difficulties, please follow the steps shown in Your Trip, which would have been sent to you at the time of booking. If the issue cannot be resolved locally you can contact us in the UK, again outlined in Your Trip. In the unlikely event that an acceptable solution cannot be found, you should then write to us within 28 days of your return with full details of your complaint. If you fail to follow this complaints procedure, we are unlikely to be in a position to properly investigate the matter further. 
11. Governing Law
These terms and conditions are governed by the laws of Costa Rica, as well as adhering to the UK Package Travel and Linked Travel Arrangements Regulations 2018 (PTR).
12. Financial Protection 
The PTR require us to provide security for the monies that you pay for the package holidays directly booked from us and for your repatriation in the event of our insolvency. All passengers booking with Cecropia Travel are fully insured for the initial deposit, and subsequently the balance of monies paid as detailed in your booking confirmation form. The policy will also
include repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to the
insolvency of Cecropia Travel.
This Policy is issued by Evolution Insurance Company Limited which is registered in Gibraltar No. 88737 with a
registered office at 5/5 Crutchett’s Ramp, Gibraltar, GX11 1AA.
Evolution Insurance Company Limited is authorised and regulated by the Financial Services Commission in Gibraltar
and authorised and subject to limited regulation by the Financial Conduct Authority (FCA) in the UK. Details about the
extent of our authorisation and regulation by the FCA are available from us on request.
13. Changes to Terms
We reserve the right to update or modify these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately.
Due to the
fluctuating rates of the US dollar and pound sterling, our tour package prices may be subject to change with immediate effect.

15. Promotional Terms
From time to time, we may run promotions and special offers (Promotions) on our website which are subject to both these Booking Conditions and any additional promotion-specific terms which are incorporated into these Booking Conditions by reference. You should ensure that you read the specific conditions that apply to each Promotion.
Promotions are available for a limited time, as defined on our website. We reserve the right to cancel or change any Promotion at any time in our discretion. By purchasing a trip on a promotional basis, you agree and accept the terms that apply to the applicable Promotion. In the event of any inconsistencies between these Booking Conditions and the Promotional terms, the Promotional terms apply to your booking.
16. Change of Itinerary
The nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that some factors may be subject to change without prior notice due to local circumstances or events. This can include, but not limited to: the route, schedules, itineraries, amenities and mode of transport.
While we endeavour to operate all trips as described we reserve the right to change the trip itinerary, which may be before or after your departure. We will notify you of any changes to the itinerary.
17. Acknowledgment
By booking a trip with Cecropia Travel, you acknowledge that you have read and understood these terms and conditions and agree to be bound by them.

Referral Scheme Terms & Conditions (UK Residents Only)

1. Promoter
1.1. The promoter of this referral scheme (“Scheme”) is Cecropia Travel, a company registered in England & Wales.

2. Eligibility
2.1. The Scheme is open to residents of the United Kingdom only and aged 18 years or over.
2.2. Employees, agents, or affiliates of Cecropia Travel, and their immediate families, are not eligible to participate.

3. Overview of the Scheme
3.1. The Scheme rewards existing customers or contacts (“Referrers”) who recommend our services to new customers (“Referees”).
3.2. A Referrer may be eligible to receive a cash incentive where:
(a) they refer a Referee to us; and
(b) the Referee makes a qualifying booking with us in accordance with these terms.

4. Qualifying Referral
4.1. A referral will be considered valid if:
(a) the Referee is a new customer who has not previously made an enquiry or booking with us;
(b) the Referee clearly identifies the Referrer at the time of initial enquiry or before booking confirmation; and
(c) the booking meets the minimum criteria set out in clause 5.
4.2. We reserve the right to determine, at our sole discretion, whether a referral is valid.

5. Qualifying Booking
5.1. A “qualifying booking” is a holiday booking to Costa Rica made through us which:
(a) has a minimum total value of £7,000;
(b) is confirmed with a deposit or full payment; and
(c) is not cancelled or refunded.
5.2. The booking must be completed within 12 months of the referral.

6. Referral Reward
6.1. The Referrer will receive a cash incentive of £50 per qualifying booking.
6.2. The reward will only be payable once:
(a) the Referee’s booking has been fully paid; and
(b) the Referee has completed their travel.
6.3. Payment will be made within 30 days of the conditions in clause 6.2 being met.
6.4. Payments will be made via bank transfer.

7. Limits and Restrictions
7.1. There is no limit of referrals per Referrer per calendar year.
7.2. Self-referrals are not permitted.
7.3. Referrals must be made in good faith and not through spam, bulk messaging, or misleading practices.
7.4. We reserve the right to withhold or cancel rewards where fraud, abuse, or breach of these terms is suspected.

8. Tax Liability
8.1. Referrers are responsible for any tax liability arising from receipt of referral payments.

9. Data Protection
9.1. By participating in the Scheme, Referrers confirm they have permission from the Referee to share their contact details with us.
9.2. Personal data will be processed in accordance with our Privacy Policy and applicable UK data protection laws.

10. Changes and Termination
10.1. We reserve the right to amend, suspend, or terminate the Scheme at any time without prior notice.
10.2. Any changes will not affect rewards already earned in accordance with these terms.

11. Liability
11.1. To the fullest extent permitted by law, we shall not be liable for any loss, damage, or disappointment arising from participation in the Scheme.

12. Governing Law
12.1. These terms are governed by the laws of England and Wales.
12.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
